Terms of Service

1. Agreement

By engaging FabBuilds ("we," "us," "our") for any web development, design, automation, or related services, you ("Client") agree to these Terms of Service. If you do not agree, do not proceed with a purchase or project.

2. Services

FabBuilds provides custom web development, funnel design, mobile app development, AI tools, automation workflows, and related digital services. Scope of work for each project is defined at the time of purchase or agreement. Any work outside the agreed scope may require a separate quote.

3. Payment

A deposit is required before work begins. Final payment is due upon project completion, prior to delivery of final files or site launch. All sales are final. Refunds are not issued once work has commenced. Payments processed through Stripe are subject to Stripe's own terms and policies.

4. Intellectual Property and Ownership

Upon receipt of full payment, the Client owns all custom code, designs, and assets created specifically for their project. FabBuilds retains the right to display completed work in its portfolio unless the Client requests otherwise in writing. Third-party licenses (fonts, plugins, stock assets) remain subject to their respective terms.

5. No Guarantee of Results

FabBuilds does not guarantee any specific business outcomes, revenue, return on investment, lead generation, search engine rankings, or sales results from any project. Any case studies, testimonials, or client results displayed on this website reflect individual experiences and are not typical. Results vary based on industry, market conditions, client effort, and other factors outside our control. Nothing on this site constitutes a promise or guarantee of financial performance.

6. Client Responsibilities

The Client is responsible for providing accurate content, brand assets, credentials, and timely feedback. Project timelines depend on the Client's responsiveness. Delays caused by the Client may affect delivery dates. FabBuilds is not liable for delays resulting from the Client's failure to provide required materials.

7. Limitation of Liability

To the fullest extent permitted by law, FabBuilds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or loss of data. Our total liability for any claim arising out of or related to our services shall not exceed the amount paid by the Client for the specific project giving rise to the claim.

8. Revisions and Disputes

Each project includes a defined number of revision rounds as agreed upon at the start. Additional revisions beyond the agreed scope will be billed separately. Any disputes should be raised in writing within 14 days of project delivery. We will make reasonable efforts to resolve issues before any escalation.

9. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Miami-Dade County, Florida.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
